Do you need a lawyer?

Some times legal issues can be worked out with arbitration or small claims court.  Sometimes, you know you just plead guilty and pay your fine (think traffic court).

But many issues do require lawyers for a variety of reasons. Regardless of your reason, you need to be knowledgeable and cautious in order to get the best lawyer for your needs.

Family, friends, and neighbors may have some suggestions for you. You will probably  get a good recommendation from someone you trust. If you need a business lawyer, talk to business people for recommendations.  For instance, if you have a small business and need a lawyer , talk to an estate broker, banker, accountant, etc. They will have experience with these lawyers and be able to help you.

Is your case criminal or civil?  It can be both, but if you are charged with a criminal case, you need a criminal defense lawyer immediately.  The “state” files the case against you and while you have a number of constitutional rights, if your case is of criminal nature,  you should say nothing without a lawyer present.  Civil cases are usually filed by a person (or an incorporated business who is seen by law as an individual). Make sure you are looking for the right type of lawyer.

Any time you meet with a prospective lawyer, request a written estimate of fees. These may vary tremendously from one lawyer to another due to the lawyer’s experience.

Work with your lawyer to figure out the best time to get together. There are attorneys who do not regularly contact their clients. Set up a schedule to confirm that everything is under control.

Having an open line of communication with your lawyer is very important. If you have deadlines related to your case, you need to make sure your lawyer knows the deadlines and any immediate question or problems.

If you are unsure of whether your attorney is handling your case properly, obtain a second opinion. There will be a fee of course, but you will either be reassured with your original lawyer or if you need to switch lawyers.  Find a referral service to get a top notch lawyer.

Check into the qualifications before choosing a referral service. If a lawyer guarantees victory, leave.
